By accessing this website and placing an order, you acknowledge that you have read, understood, and agreed to these Terms of Business. These terms are governed by the laws of Poland and, where applicable, the United Kingdom.

1. Contract Formation

Orders are accepted only by email at info@derasta.pl.

To proceed, buyers must provide complete company details, product use information, and any verification documents requested.

A binding contract is created only after DERASTA sends a written confirmation.

Payment: Full payment is required upon receipt and inspection of goods, before unloading. Title to goods transfers to the buyer only after full payment is received.

2. Buyer Responsibilities

Due Diligence

Buyers must be 18 years or older.
Valid business registration and identification must be provided upon request.
Products must be purchased only for lawful culinary, medical, laboratory, or industrial use.

Authorisation

Business buyers must confirm they are the beneficial owner of the purchasing company or are acting under written authorisation.

Import & VAT

Buyers are responsible for customs clearance within three (3) months.
Intra-community reverse-charge VAT rules apply where relevant.
Buyers indemnify DERASTA against penalties or tax liabilities caused by misreporting.

3. Product Use and Compliance

DERASTA supplies N₂O cream chargers, medical gases, and related products only for legitimate purposes.

Buyers agree not to:

Misuse or promote misuse of products for psychoactive or recreational inhalation.
Supply to minors or anyone suspected of intending misuse.

UK Clients: Sales for recreational use are prohibited under the Psychoactive Substances Act 2016.

Polish Clients: Must comply with the Act on Counteracting Drug Addiction and relevant Ministry of Health regulations.

4. Verification and Onboarding

All UK business clients must complete the DERASTA Account Opening Application before their first order.

DERASTA may verify company registration, VAT status, ownership, and intended product use.
Orders may be refused if verification fails or onboarding requirements are not met.

5. Safety, Storage, and Handling

Buyers must follow all applicable EU and Polish regulations regarding compressed gas handling.

Products must be stored:

In a cool, dry, well-ventilated area.
Away from heat, open flame, or flammable materials.
Under supervision of trained and insured personnel.

6. Liability and Indemnity

DERASTA’s liability is limited to replacement, repair, or refund for defective goods covered by warranty.

The company is not liable for:

Misuse, inhalation, or mishandling of products.
Indirect, incidental, or consequential damages.

Buyers agree to indemnify DERASTA against any losses or claims resulting from misuse or unlawful resale.

7. Confidentiality

Any confidential information shared by DERASTA must remain protected and may not be disclosed without written consent.

Confidentiality obligations continue for five (5) years after the business relationship ends.

8. Privacy and Data Protection

Personal and business data are processed in line with:

EU and Polish GDPR (RODO)
UK Data Protection Act 2018 for UK clients

9. Governing Law and Jurisdiction

These Terms are governed by the laws of Poland.

Where applicable, UK law may also apply.

Any disputes shall fall under the exclusive jurisdiction of the courts of Warsaw, Poland, unless consumer law requires otherwise.
